Process to handle illegal buildings

In accordance with Article 4 of Regulations for Handling Illegal Construction, the inspecting and reporting staff should report immediately to the competent authority any illegal construction cases in violation of the Building Act whether they are in new addition, alteration, or repair. Article 5 of the same Regulations stipulates that within 5 days after receipt of the report from the inspecting and reporting staff, the local competent authorities shall make a field survey. If the construction is judged to be dismantled, dismantlement must be carried out right away. If it is determined not yet reaching the level of dismantlement, the owner of the illegal construction must be notified to apply for the license in accordance with Article 30 of the Building Act within 30 days after receipt of the notification. If the owner does not follow the rules or apply for the license within the time limit, the local competent authorities should immediately demolish the construction in question.
